UK opposition party leader says Google tax behavior 'wrong'

LONDON (Reuters) - Google Inc's tax affairs will come under renewed scrutiny in Britain on Wednesday when the leader of the opposition Labor party accuses the Internet company of wrongly going to "extraordinary lengths" to avoid paying tax.

In comments designed to politically outflank Prime Minister David Cameron ahead of next month's G8 summit on what has become a high-profile issue, Ed Miliband, the Labor leader, will say he is disappointed that Google pays so little tax.

"I can't be the only person here who feels disappointed that such a great company as Google ... would be reduced to arguing that when it employs thousands of people in Britain, makes billions of pounds of revenue in Britain, it pays just a fraction of that in tax," Miliband will tell a Google event held just outside London.

"So when Google does great things for the world, as it does, I applaud you, but when Google goes to extraordinary lengths to avoid paying its taxes, I think it's wrong."

Google's methods of minimizing its British tax bill have made front page headlines in Britain and angered voters at a time when their own incomes are being squeezed, putting pressure on politicians to be seen to be taking action.

British lawmakers have accused Google of using "smoke and mirrors" to avoid paying tax and the firm's Northern Europe boss, Matt Brittin, was called back to testify to MPs after a Reuters investigation showed the company employed staff in sales roles in London, even though he had told the committee in November its British staff were not "selling" to UK clients.

But Cameron, who has placed global tax regulation at the heart of the G8 summit he is chairing in June, has been coy about singling Google out for criticism, preferring to talk more generally about corporate tax avoidance.

Miliband, whose party is ahead of Cameron's Conservatives by up to 10 percentage points in opinion polls, criticized Cameron for not taking a tougher line.

"Google is said to have paid only 10 million pounds in corporation tax in the UK between 2006 and 2011, despite revenues of 11.9 billion pounds," Miliband wrote separately in a blog for The Huffington Post UK on Tuesday.

"I was surprised the prime minister failed to raise this when (Google Executive Chairman) Eric Schmidt attended the business advisory council's meeting." Cameron was too distracted by other issues, he said.

Britain will host a meeting of G8 leaders on June 17-18 at a golf resort in Northern Ireland and Cameron said in April that tax compliance was one of his G8 priorities.

Google is one of several high-profile companies to face far greater scrutiny of its tax affairs in recent months. Apple Inc., Microsoft and Amazon.com have all been in the spotlight at a time of weak economic growth, high levels of public debt and squeezed household incomes in Britain.

IRS officials back on Capitol Hill hot seat over targeting

WASHINGTON (Reuters) - A Senate panel will try on Tuesday to pry more details out of current and former officials of the Internal Revenue Service about the agency's targeting of conservative groups for extra scrutiny when they sought tax-exempt status.

Lawmakers are also expected to demand answers about why officials did not earlier share with lawmakers evidence that IRS workers in Cincinnati, Ohio, had inappropriately focused on search criteria that included "Tea Party" and "patriots."

A Senate Finance Committee hearing will give members the first public opportunity to question former IRS Commissioner Douglas Shulman, who headed the tax-collection agency from 2008 to late 2012, during which the targeting occurred.

Senators will likely seize on Shulman's congressional testimony in late March 2012 that no groups were being targeted for extra scrutiny by the tax agency.

It has since emerged that the behavior started in March or April of 2010 and continued for 18 months.

A Treasury Department watchdog has said he informed Shulman about an investigation into the matter in May 2012, but assumed IRS officials would have given Shulman a heads up before that.

Senators are expected to aim another round of tough questions at the outgoing acting head of the IRS, Steven Miller, who refused to give specifics about who was involved in the scandal during a House of Representatives hearing last week.

Miller was forced to resign last week and more senior agency officials could be on the firing line in the broadening scandal as members of both parties rush to condemn the IRS for overstepping its authority.

The hearing on Tuesday is scheduled to start at 10 a.m. EDT.

The rising political storm has undercut President Barack Obama's second-term agenda and put the White House on the defensive as he tries to negotiate a budget deal with Republicans and push a comprehensive immigration reform bill through Congress.

The hearing in the Democratic-controlled Senate Finance Committee will feature a push for more details about who ordered the extra tax scrutiny for conservative groups. It will also focus on whether the White House was slow to divulge the practice once it learned of it.

Those questions gained more urgency on Monday when the White House revealed that two senior aides to Obama knew weeks ago about a draft Treasury Department watchdog report detailing the IRS targeting that occurred for an 18-month period starting in early 2010.

White House spokesman Jay Carney said White House Counsel Kathryn Ruemmler was notified on April 24 of the report's preliminary findings, and that she told Chief of Staff Denis McDonough and other senior staffers soon afterward.

Obama has said he did not learn of the report's findings until May 10, when IRS official Lois Lerner apologized for the targeting at an American Bar Association conference.

The leaders of the Senate Finance Committee - Democratic Chairman Max Baucus of Montana and senior Republican Orrin Hatch of Utah - sent the IRS a letter on Monday seeking a broad range of documents and asking more than 40 questions covering three years of IRS activity.

"Targeting applicants for tax-exempt status using political labels threatens to undermine the public's trust in the IRS," Baucus and Hatch said in a letter to Miller. "Lack of candor in advising the Senate of the practice is equally troubling."

'MORE IS GOING TO COME OUT'

Among other things, the two senators asked for the names of all employees involved in the targeting effort and for copies of any communication between IRS employees and outside parties, including anyone in the White House or Treasury Department.

They also asked for the names of any IRS employees who became aware of anyone at the White House or Treasury who knew about the practice.

"I have a hunch that a lot more is going to come out, frankly," Baucus said in an interview on Sunday with Bloomberg Television. "I suspect that we will learn more in the next several days, maybe the next couple three weeks which adds more context to all of this."

The Senate Finance Committee is conducting one of three congressional probes into the scandal. The House Ways and Means Committee held the first hearing last week, and the House Oversight and Government Reform Committee will hold a hearing on Wednesday.

Lerner, head of the IRS tax-exempt organizations office, is scheduled to testify at Wednesday's hearing.

The Justice Department is also looking into the IRS practice, which has drawn angry accusations of a cover-up from Republicans who have accused Obama's administration of using government powers to punish political rivals.

Some Democrats, while also condemning the practice, have noted the IRS was headed by Shulman - an appointee of Republican President George W. Bush - during the period in question. Shulman has, however, donated to Democrats.

Also testifying at Tuesday's hearing with Shulman and Miller will be J. Russell George, the head of the watchdog group that issued a report on the IRS last week. George testified at the House hearing last week and said his office is continuing to investigate the matter.

Lovelorn frogs bag closest crooner

May 20, 2013 ? What lures a lady frog to her lover? Good looks, the sound of his voice, the size of his pad or none of the above? After weighing up their options, female strawberry poison frogs (Oophaga pumilio) bag the closest crooner they can, finds research in BioMed Central's open access journal Frontiers of Zoology. This seemingly short-sighted strategy turns out to be the optimal mate choice strategy for these colourful frogs.

Males of the species congregate in the Costa Rican rain forest 'lek-style' to display and call together, giving females the chance to weigh up multiple males at once. But despite their best efforts, build and territory size, females tend to mate with the closest calling male, Ivonne Meuche from the University of Veterinary Medicine, Hannover, Germany, and colleagues report.

The find was confirmed by playback experiments where females, played recordings of various male calls, failed to discriminate between different call rates or frequencies, preferring instead, the nearest speaker.

Female mate choice is a tricky business. Some species chose the first mate that is 'good enough' whilst others seek out and compare many mates before returning to choose the fittest. But the simplest, least costly option is to mate with the first or nearest male encountered, regardless of quality. The strategy doesn't seem an evolutionary winner as it means that nearby, unfit frogs sometimes get to pass on their genes at the expense of more distant, genetically-superior specimens. But it does make sense in certain situations.

Non-choosy behaviour like this has been noted in fishes, and some frog species with a lek-like mating system. It's thought the strategy works for them because it reduces 'costs' in terms of search time and competition for mates. Female strawberry poison frogs may also benefit little from 'shopping around' because strong inter-male competition means the available mates are all much of a muchness.

The team also noted that females unable to find a mate within a certain time period ended up laying unfertilised eggs that never hatch. So in species, like the strawberry poison dart frog, where the choosing sex outnumbers the chosen sex, it makes sense to 'grab the nearest guy' rather than run the risk of not mating at all.

Pakistan's Musharraf granted bail in Bhutto case

ISLAMABAD (AP) ? A lawyer for Pakistan's former military ruler says a judge has granted Pervez Musharraf bail in a case related to the murder of former Prime Minister Benazir Bhutto.

Despite the bail, the former military strongman is to remain under house arrest on the outskirts of Islamabad in connection with two other cases against him.

Lawyer Salman Safdar said Monday that the bail was about $20,000.

Government prosecutors have accused Musharraf of being involved in the gun and suicide attack that killed Bhutto in 2007 when he was in power. They have also blamed him for not providing the former premier with enough security.

Musharraf has denied the allegations and claimed they were politically motivated.

My parents have spent over ?20,000 to employ, Greenway Home Improvements Ltd to construct a conservatory & porch. Only to discover the conservatory is NOT energy efficient, doubts regarding the roofing system (supplied by Ultrafame) being structurally safe following an incident where the conservatory double glazed glass roof 10?x2?6? panel fell out of the roof frame, bowing down into the conservatory and allowing water to enter.

Greenway?s Fitters, Steve & John neglected to full fill the contract (agreed by Tom Tucker, Greenway Salesperson), by not carrying out the necessary building work whilst constructing my parent?s bricked porch. This Andrew Green ? MD of Greenway Home Improvements Ltd will not address, neither will Matthew Glover & Greg Kane of Conservatory Outlet.

The following is a brief summary of the complaint?(a brief summary was sent to Greenway, email dated 13 July 2011):-

1.A 10? x 2?6?Double Glazed Roof Glass Panel come out of the roof frame and bowing down into the conservatory. This happened 16 weeks after completion.

2.Roof support trims, some supplied undersized and fitted by Steve, John, & Rob, some cut too small (near the roof valley) and fitted by Steve, John & Rob. Steve & John had no intention of replacing these trims, even though the trims were not fit for purpose, thus not making the conservatory energy efficient, allowing water and draughts in.

3.Steve, John & Rob had little respect for the my family property on many occasions, using home appliances without asking permission, breaking items around the garden and hiding them in shrubbery.

4.Rob the fitter for Greenway?s got aggressive with me, for cleaning the conservatory. Yet I used the method that was relayed to me by Ian Haines, the Greenway surveyor.

5.My family had to experience the backlash from Steve & John for the previously arranged, (with Tom Tucker & Ian Haines), internal door to be temporally boarded up while the front door was waiting to be replaced. (Security reasons) The discussion between Steve & John went as far as to call someone ?twatters?.

6.My family made enquiries to Ian Haines regarding the investigation work allegedly carried out by Steve & John into the depth of the footing already present for the new porch brickwork. (Were these footings suitable?) There was no evidence to prove this was conducted by Steve & John. Yet these instructions are on the contract.

7.Steve& John signed off the conservatory and left a considerable hole between the house wall and the conservatory. Allowing water to enter the conservatory.

8.Steve, John & Rob left the backing on, the adhesive strips on the roof trim. Thus the glass was not secured completely.

9.Steve called the my family liars concerning a crack in the double glazed glass panel, from the side of the conservatory. This crack rendered the double glazed unit as non-energy efficient.

10.Steve & John became aggressive towards my family, when we enquired why the double glazed roof panel had fallen out of the roof frame.

11.Steve & John have lied to the company, Greenway in regards to the customers (my family), not leaving the fitter alone to carry out the job (CCTV recordings to substantiate that Steve & John are not being truthful). Furthermore, if my family were constantly bombarding the fitters with question, as the fitters claimed. How did Steve have the opportunity to once again smear silicon up on the middle of a pane of the self-cleaning glass on the conservatory?

12.The fitters Steve & John, not only made the customers feel uneasy by their aggression, on?28 February 2011 & 22 June 2011(whilst in the my family?s home),but also when Steve called Andrew Green the MD of Greenway, a liar and stated he would tell him (Andrew) this to his face. This is not very customer friendly.

13.Steve & John have gone as far as to slander my family (Greenway Customers) to discredit their characters in order to deflect the issues/matters/complaints from themselves, the causers of the conflict.

The above is a proportionate account of how Steve, John& Rob fitters of Greenway Home Improvements Ltd have treated my family.

The response I received from The MD Mr Andrew Green, of Greenway Home Improvements Ltd was:-

?have decided that your e-mail counterproductive. In Response, I have skipped to the end??

To clarify matters.

The installation was stated as being complete and fit for purpose on?24 February 2011(fitters Steve, John & Rob of Greenway)

Yet Greenway fitters (Steve & John) returned?28 February 2011?to carry out issues on the conservatory.

Greenway fitter (Rob) returned on?19 May 2011?to carry out further issues with the conservatory e.g. water entering through holes in roofing trims etc. Rob got very aggressive towards me when discussing how the water was entering the conservatory. Also, Rob prised the double glazed roofing panel up to remove the backing from adhesive seals, which had been left on during installation by Steve, John & Rob. The valley capping and guttering was misshaped following Rob?s manhandling of the roofing glass. It was also reported to Rob that the guttering surrounding the conservatory sloped away from the down-pipe, thus holding at least 20mm of water.

What I found strange was that, Rob at this point knew exactly where the holes were situation in the conservatory roof, prior to any member of my family indicating how the water was entering the conservatory. How? Unless the fitter (Steve, John & Rob) knew the state they had left the conservatory in.

Greenway ? MD Mr Andrew Green visited, on?25 May 2011, my family home, following the aggressive behaviour of Rob, the damage left by Rob and the issues (structural, energy efficiency etc.) with the conservatory.?Mr Andrew Green took away a considerable list of outstanding issues, which now appear to?have disappeared. Stated as, Mr Green will not refer to the issues itemised on this lists, just keeps reiterating, ?complete this one small item?.

During Mr Green?s visit of?25 May 2011, it was agreed by both parties?(Mr Green & my family) that not to cause any further damage to the glass or surrounds, that additional trims would be added inside and outside to cover the substantial holes in the roofing trims. Mr Green also agreed that an additional down-pipe would be added to drain away the substantial water that was being held in the guttering. There were also problems with the valley capped that had been misshaped, flashing and the internal sills. All were itemised on Mr Green?s list to be rectified.

20 June 2011at approx. 8.30 pm?I entered the conservatory and found water entering from the roof. On inspection it was discovered that one of the roof panels had fallen out of the roof support. Quickly furniture was moved, dust sheets were put down and my family had to prop up the glass in the roof(the double glazed glass panel which is approx. 10 foot x 2?6 had bowing out of the frame in the roof). An e-mail was sent to Mr Green marked as, emergency as my family feared the roof glass could collapse in.

21 June 2011?A member of my family telephoned Mr Green as there had been no response to the emergency e-mail. Mr Green was asked if he could came and look at the roof .Mr Green stated he was unavailable all day and would send Mr Haines (Greenway Surveyor), as he was the more of the structurally minded person, than Mr Green. Greenway confirmed that Mr Haines was to call when he returned from Gloucester. At approx.?3.10 pm on

21 June 2011my family?e-mailed Mr Green following Mr Haines non arrival.

At approx.?3.20 pm on 21 June 2011?Mr Haines arrive, at my family Home. Mr Ian Haines (Greenway surveyor) looked at the roof and informed my family to leave the prop holding the glass up in place for safety. My family discussed again the problems of the roof trims that were letting in draughts and water, etc. Mr Haines explained the trims are delivered pre-cut, except for the trims either side of the roof valley. My family know for a fact, the valley trims were:- one side undercut leaving a 1cm+ hole and the other wrongly fitted, at an angle, leaving another gap. When discussing the problems, each time Mr Haines response was, ?see John & Steve when they call tomorrow?. Mr Haines also said he would phone the fitters at home that night. Additionally, Mr Haines did add that the supplier might have to become involved.

22 June 2011 at approx. 9.10am, John and Steve arrived; my family enquire the explanation of why the glass had come out of its frame, but both John & Steve were not forth coming with answers. My family did notice Steve didn?t reset the double glazed roofing panel, simply prised the glass panel across the roof frame with a screw driver. Questions were asked to the fitters, relevant to the job in hand. During the discussion with the fitters, it became apparent that all Mr Green had previously promised, was not going to happen according to Steve & John. Steve even went as far as to call Mr Green ?A liar ????.?and? I?ll tell it to his face.? This put my family in a very awkward position. The fitters left at approx. 9.40am, stating that John was going to telephone Mr Green and request a follow up telephone call to my family. Following the fitters departure it was once again found that the fitters has smeared silicon on the centre of one of the self-cleaning panes of glass. This was a habit of Greenway Fitters while working on my family?s conservatory.

Anyone can clearly see, Greenway Home Improvements Ltd has had ample opportunities to rectify the list of issues with my conservatory and in fact each time has?caused further damage.

Yet, Mr Andrew Green MD of Greenway Home Improvement Ltd, will not address the substantial complaint concerning the porch project, the poor workmanship, the attitude from Greenway Fitters, Steve, John, Rob and the conservatory project in its entirety (itemised on Mr Greens list taken on?25 May 2011). Yet Mr Green has acknowledged photographs of the poor workmanship of his fitter that were forwarded to Ultraframe, the suppliers of the roofing system.

Sanchez German and Garcia Ivan of Mexico secured gold medal of the Men?s 10m Synchronised Platform on day one of the FINA/MIDEA Diving World Series 2013 in Guadalajara, Mexico on Friday, May 17.

The Mexican pair devastated hopes of their challengers in the final of the 10m event as they remained comfortably ahead of them and grabbed the title. With their unrelenting efforts, the duo earned a prominent lead in the first round and reached the podium for the title.

With their exceptional efforts, Sanchez and Garcia gained a lead of two points from their toughest challenger in the first round as they secured 52.80 points while Minibaev Victor and Chesakov Artem of Russia managed to get only 50.40 points.

Similarly, the Mexican pair extended their lead by 0.60 points in the second round as they secured a total of 54.60 against Russia?s 54.00 points.

Following that, Garcia and Sanchez continued their nerve-wrecking efforts in the third and fourth rounds as they accomplished 89.91 ad 88.11 points respectively. In contrast, Minibaev and Chesakov were only able to get 86.40 and 83.25 points respectively.

The same continued in last two rounds, where the German pair achieved 92.07 and 90.06 points as compared to the 74.52 and 79.92 points of Minibaev and Chesakov.

The Mexican pair was able to secure gold medal of the event with a score of 467.55 points. The gold medallists were followed by Russian duo that gained silver medal of the event with 428.49 points.

Third spot of the event was obtained by Guerra Jose Antonio and Aguirre Jeinkler of Cuba, who were able to reach the podium for bronze medal with a score of 409.11.

Subsequently, the crowd witnessed gruelling efforts of Rios Lopera Juan and Ortega Victor of Colombia, who were able to overwhelm any of their challengers. The duo remained nearly six points away from the Colombian pair as they secured 403.65 points.

In addition, the Mexican pair expressed happiness over their victory in the 10m synchronised event while the position holders were invited on the medal rostrum for awards and accolades after the session.

Algeria pilots' strike grounds national carrier | Morocco World News

ALGIERS, May 18, 2013 (AFP)

Air Algerie planes were grounded for several hours on Saturday when the national carrier?s pilots staged a wildcat strike over pay, aviation industry sources in the North African country said.

News agency APS reported pilots at Algiers airport as saying their demands related to salaries, although no official of the aircrew union was available for comment.

Morning talks between management and the union were reported to have ended in agreement, APS added.

The work stoppage caused delays not only with Air Algerie flights but also with other carriers, an airport source said, before normal operations resumed in the afternoon.

An expansive penthouse at 320 West 12th Street, a former nursing home converted to luxury condominiums, sold for $29,783,812.50 and was the most expensive residential sale of the week, according to city records.

The seven-bedroom, eight-bath apartment was created by combining No. 9, a four-bedroom, three-and-a-half-bath duplex originally listed for $19.5 million, with No. 7, a $10.5 million 3,200-square-foot unit below it, for a total of 8,500 square feet over three floors. It also has 1,200 square feet of outdoor space.

The buyer, represented by Giampiero Rispo of Domus Realty and Brett Miles of Town Residential, used a limited-liability company, Abingdon Property NYC.

?I think, what the buyer saw in it was this rare opportunity to aggregate serious square footage,? said Tim Crowley, the managing director of Flank Development, which handled the conversion of the building, now known as the Abingdon.

The buyer was looking to relocate ?a big family? downtown and had an open budget, Mr. Rispo said, but finding a suitably large apartment with outdoor space was not easy. ?We checked everywhere,? he said, ?and in any price range it was impossible.? He added that the search also involved a visit to the rock star Jon Bon Jovi?s SoHo condo, listed for $42 million.

The Abingdon, formerly known as 607 Hudson, was bought for $33.3 million in January 2011. Although there are plenty of large town houses on prime blocks on the Upper East Side, Mr. Crowley noted, homes with 8,500 square feet in the West Village are ?unheard-of.? Theoretically, he said, you might be able to cobble two West Village town houses together to get similar square footage, but finding a prewar boutique condo in the West Village with that amount of space ?is probably as close as you will see to a once-in-a-lifetime real estate opportunity in this city.?

Town-house-size living was what Flank Development had planned when it converted the seven-story building into just 10 units, all larger than 3,200 square feet. The 1905 structure was once a home for working women; it was later a 200-bed nursing home. In its current iteration, it houses a gym and a sauna, and offers the services of doormen and porters.

The nearly $29.8 million sale price makes it the second-costliest deal in the West Village in recent years, according to Cityrealty.com. The 2010 sale of a 6,300-square-foot penthouse at 400 West 12th Street, the Superior Ink building, for $31.5 million, or roughly $5,000 a square foot, remains the most expensive.

In Tanzania, they are native ? living in terrestrial habitats or on land. But back in the United States they are an invasive species. Not only do they devour vegetation of most any type they also carry a parasite ? rat lungworm, which can be picked up from their slime trails. The snails get the parasite from eating rat feces. Rat lungworm can cause meningitis Seeing that study rats and come across these snails all of the time, I?m feeling some kind of way about these snails (like I need some other weird disease to worry about getting from my rats)?but the shells are still big and pretty.

Well, if this fella had walked inside of my trap, then he would have surely tripped it closed and been stuck inside until I come along to free him.

How did they come to be a problem in the United States? Exotic (non-native) species can reach new areas a number of ways ? by accident or deliberately. However, it seems like these snails were brought here deliberately. Some people like them as terrarium pets. I know that some snails are regarded as a delicacy (not sure about these species) but it?s big enough to provide a hardly meal for something.

Inmate In Wisconsin Jail Knocks Out Guard With 1 Punch (VIDEO)

It was swift and brutal. An inmate at a Wisconsin jail knocked out a guard with one punch, newly released video shows.

Caught by surveillance cameras, the March 27 fight apparently erupts as three corrections officers gather lunch trays and another enters the room. The alleged puncher, identified by the Marathon County Sheriff's Department as Fredrick Morris, can be seen in the footage adopting a fighting stance and coldcocking Officer Julie Christensen with a right hand to the face. She falls hard to the floor while Morris tangles with another guard.

Christensen (also spelled Christiansen in court documents) was knocked unconscious by the hit from Morris and was taken to intensive care and remained hospitalized as of Thursday, Wisconsin Public Radio (WPR) reported.

According to WPR, a deputy claimed that during the incident prisoners had shouted, "Hope she dies," as Christensen lay on the ground.

Morris was charged with several counts of battery, according to a criminal complaint. He was transferred to a facility in Lincoln County, Wisc., the Marathon County Courthouse told The Huffington Post on Friday.

After the attack, safety conditions at the Marathon County jail were evaluated by a civilian panel this week, CBS local affiliate WSAW reported.

"What I saw was a battlefield," panel chair Paul Jones said of the video footage, per WPR. Another panelist, Mike Beck, said the incident made him distrust the jail's administration.

The gold miners exchange-traded fund?GDX?has plummeted to its lowest point since December 2008 as the precious metal has lost ground, putting it in a new light, Strategic Financial Group CIO Lincoln Ellis said Friday.

"The bloom is definitely off the rose in the gold market, and the gold miners are feeling it, too," he said, adding that the pain trade in gold "has been twice the pain" for miners.

The?Market Vectors Gold Miners ETF, as the GDX is called, closed down 4 percent at $26.38.

"And things are starting to look cheap," he added.

The gold mining sector could start to see consolidation or supply restrictions, Ellis said.

Spot gold?declined 1.6 percent, hovering at a four-week low below $1,364 an ounce, Reuters reported.?U.S. gold futures?for June delivery dipped 1.6 percent at $1,364.70.

"If the dollar continues to strengthen, gold will continue to come down, those margins'll compressed and the valuations will continue to look reasonable, or in some cases slightly cheap," Ellis said. "Hopefully, you get consolidation in the bottom part of that index. That would also be helpful to the top-tier players."

Ellis added that gold has fallen out of favor as a safety trade.

"Everybody who's wanted to be long gold has been long gold, and that trade is over," he said. "Those people are exiting that trade."

Now, he argued, the story was more about fundamentals in such emerging economies as India and China.

"Moving away from gold as the driver but looking more to the fundamentals of what's going on in the mining business, a broader commodity issue, may be a reason to take a second look at them," Ellis said.

X-ray tomography on a living frog embryo

Classical X-ray radiographs provide information about internal, absorptive structures of organisms such as bones. Alternatively, X-rays can also image soft tissues throughout early embryonic development of vertebrates. Related to this, a new X-ray method was presented recently in a Nature article published by a German-American-Russian research team led by KIT. For periods of about two hours, time-lapse sequences of cellular resolution were obtained of three dimensional reconstructions showing developing embryos of the African clawed frog (Xenopus laevis). Instead of the absorption of X-rays, the method is based on their diffraction (DOI: 10.1038/nature12116).

"X-ray diffraction enables high-resolution imaging of soft tissues," explains Ralf Hofmann, one author of the study and physicist at KIT. "In our work, we did not only manage to resolve individual cells and parts of their structure, but we could also analyze single cell migration as well as the movement of cellular networks."

Using X-ray diffraction, similar tissues can be distinguished by minute variations of their refractive index. However, in contrast to classical absorption imaging, this does not require any contrast agent, and X-ray dose is profoundly reduced. The method is of particular advantage when probing sensitive tissues in living organisms, such as frog embryos. In their study, the researchers concentrated on the motion and shape changes of tissues, cavities, and single cells during the developmental milestone of gastrulation.

During gastrulation, germ layers are formed and organized in their proper locations. Thereby, an initially simple spherical ball of a few hundred cells turns into a complex, multilayered organism with differentiated tissues eventually turning into the nervous system, muscles, and internal organs. Quoting the renowned developmental biologist Lewis Wolpert: "it is not birth, marriage, or death, but gastrulation that is the most important event in your life."

"Employing X-rays, we were able to watch joint and individual cell movements during gastrulation," zoologist Jubin Kashef points out who is a co-author and head of a young investigator group at KIT. For the first time, it was appreciated how cells interact with each other in a living embryo and how regions void of cells form and disappear. "It is like the migration of peoples. Stimulated by the migration of individual cell groups, other cells join in. They form functional cellular networks, which adjust to their changing environment. During migration, cells specialize to form progenitor tissues of future organs, e.g. the brain or skin."

"It is fascinating to have digital capabilities to observe and analyze these processes in an individual living frog embryo," Hofmann and Kashef emphasize. "In this way, fundamental results are obtained." The new method not only reveals morphological and dynamic aspects of embryonic development but also provides insights into their underlying molecular biology obtained by comparing the development of wildtype embryos and morphant phenotypes. The African clawed frog (Xenopus laevis) is one of the most important model systems of developmental biology whose study is of relevance in understanding human embryogenesis and diseases. In future research, morphant phenotypes will be correlated with the targeted switch-offs of key proteins. For this purpose, the novel technique -- combining latest X-ray measurement technology with advanced image analysis and developmental biology -- will be established at the synchrotron radiation facilities ANKA in Karlsruhe and APS in Chicago for routine use by a broad community of scientific users.

In their study, KIT researchers, which were supported by biologists from Northwestern University, used coherent X-rays from the Advanced Photon Source of Argonne National Laboratory in Chicago. Prior to this investigation, the method had been developed at ANKA. During measurement, a coherent bundle of X-rays passes the nearly spherical 1-mm frog embryo, which rotates half way around its axis within 18 seconds. By variation of the irradiation direction, information on the three-dimensional (3D) structure is acquired. As X-rays pass through different types of tissues at variable speeds, diffraction occurs. In turn, this generates a characteristic intensity distribution by interference a certain distance behind the embryo. Within the 18 s of tomographic scan time, about 1200 images were recorded. Similar to digital photography, every image consists of several million pixels. From this vast amount of data, the three-dimensional structure and the development of the embryo over time is inferred at micrometer resolution. If this process is repeated at intervals of several minutes, the resulting sequence of 3D images reveals all gastrulation movements occurring inside the embryo. Image reconstruction and analysis algorithms for the here-employed X-ray phase-contrast microtomography were developed at ANKA.

Immediate results of this research are the discovery of new morphological structures and the clarification of fluid redistribution processes. Moreover, the locations of centers driving the migration of tissues and cells during gastrulation were determined by differential flow analysis.

Morrison seals $306 million Ocado deal in online catch-up

LONDON (Reuters) - British supermarket chain Wm Morrison is investing more than 200 million pounds in a 25-year deal with online grocer Ocado, seeking to catch up with rivals in home delivery and sending Ocado shares to a record high.

Morrison, which trails Tesco, Wal-Mart's Asda and J Sainsbury in annual sales, has suffered falling profits and market share, partly due to its late entry into online grocery which is growing about 16 percent a year.

Morrison and Ocado said their deal would not affect Ocado's arrangement with upmarket grocer Waitrose, due to run to 2020. Yet Waitrose, which provides many of Ocado's products, said it had instructed lawyers to advise on whether there had been any breach of contract.

Waitrose, part of the John Lewis group, said it had asked to see details of the agreement between the two companies. "Once we've done that, we'll decide what appropriate action to take," a spokesman said.

Morrison, which already sells non-food items online, had held back from selling food because of doubts over the profitability of delivering groceries to customers' homes. Ocado has yet to make a pretax profit in a decade of business.

"We think that the deal is easily a better one for Ocado than it is for Morrison," said analyst Philip Dorgan at brokerage Panmure Gordon. "The agreement lasts for 25 years which seems unnecessary to us, given the pace of change online."

Ocado shares have had a rollercoaster ride since the company listed at 180 pence in 2010. Heavily "shorted" before Friday's announcement by market participants speculating they would decline, they jumped as much as 47 percent to a record 296.8 pence, valuing the company at 1.72 billion pounds.

Shares accounting for 10 percent of Ocado's share capital were out on loan as of Thursday's close, corresponding to nearly 70 percent of those available to be borrowed, Markit data showed - an indication of the level of short-selling in the stock.

Morrison shares rose up to 2 percent.

POLARISED OPINION

Ocado has polarised opinion. Fans point to rapid growth in online grocery, with the UK market expected to double in value over the next five years to 11 billion pounds, its state-of-the-art distribution centres and high customer service ratings.

Sceptics, however, note it has not made a profit since it was founded by three Goldman Sachs bankers in 2000, and doubt its model of filling orders from central depots will ever be as profitable as online operations at grocers like Tesco and Sainsbury, which mostly pick orders in stores.

Ocado, which made a pretax loss of 0.6 million pounds in 2012, forecast the Morrison deal would deliver an annual profit contribution in the "mid-teens millions of pounds", while Morrisons' upfront payment of 170 million pounds would enable it to pay down its debt of 85 million pounds.

It said the deal was a vindication of its business model and could lead to overseas sales of its technology. "This validation should support the internationalisation of our model as well as the growth of our UK business," said CEO Tim Steiner.

Ocado entered a small supply partnership deal with French supermarket firm Carrefour in 2011.

Morrison CEO Dalton Philips said the Ocado deal would help achieve the company's home shopping aims, though it was not expected to make money until the 2016-17 year.

"This is a Morrisons website, it's Morrisons food, in a Morrisons van, with a Morrisons driver, it's Morrisons the whole way through," he said. "It's a very different arrangement from the sourcing arrangement Ocado has where they source Waitrose food," he told reporters.

Morrison's online offer will be met from Ocado's recently opened distribution centre in Dordon, central England.

It will make an initial payment of 170 million pounds to Ocado to acquire Dordon and associated equipment, as well as a licence and integration fee.

Morrison said a further 46 million pounds will be invested to expand Dordon to accommodate its range, integrate with its systems and establish a delivery network. It expected to incur a further 25 million pounds of development costs this year.

"The deal gives Morrison access to, we estimate, around 500 million pounds of online sales for an initial outlay of 200 million pounds," said analysts at Credit Suisse.

Morrisons will also pay Ocado annual service costs and a contribution to R&D expenditure, as well as at least 25 percent of Morrisons.com's earnings before interest and tax for 15 years.

Senior Treasury officials were made aware in June 2012 that investigators were looking into complaints from tea party groups that they were being harassed by the Internal Revenue Service, a Treasury inspector general said Friday, disclosing that Obama administration officials knew there was a probe during the heat of the presidential campaign.

J. Russell George, the Treasury inspector general for tax administration, testified alongside ousted IRS head Steven Miller, who did little to subdue Republican outrage during hours of intense congressional questioning. Both defiant and apologetic, Miller acknowledged agency mistakes in targeting tea party groups for special scrutiny when they applied for tax-exempt status, but he insisted that agents broke no laws and that there was no effort to cover up their actions.

Miller only stoked the criticism of many Republicans, who are assailing the administration on a sudden spate of other controversies, as well, even as some Democrats tried to contain the political damage.

"I don't know that I got any answers from you today," Rep. Mike Kelly, R-Pa., told Miller. "I am more concerned today than I was before."

At one point in the day's hearing, Treasury IG George said he had told the department's general counsel about his investigation on June 4, 2012, and Deputy Treasury Secretary Neal Wolin "shortly thereafter." But, George cautioned, those discussions were "not to inform them of the results of the audit. It was to inform them of the fact that we were conducting the audit."

After the hearing, inspector general spokeswoman Karen Kraushaar said George "informed Department of Treasury officials that we were looking into the IRS' handling of applications for tax-exempt status, partly due to allegations raised by conservative organizations."

Kraushaar said the disclosure was part of a routine briefing about the office's activities.

The Treasury Department issued a statement Friday saying officials first became aware of the actual results of the investigation in March of this year, when they were provided a draft of George's report, a standard practice.

George's disclosure came before the House Ways and Means Committee in the first of several congressional hearings on the matter. He was joined by Miller, who spoke publicly about the controversy for the first time.

Miller was contrite as he apologized for the actions of agents who singled out conservative political groups for additional, often burdensome scrutiny.

"First and foremost, as acting commissioner, I want to apologize on behalf of the Internal Revenue Service for the mistakes that we made and the poor service we provided," he told the committee. "The affected organizations and the American public deserve better."

But the hearing turned prickly when Miller insisted he did not deceive Congress, though he repeatedly failed to reveal the controversy last year when he was asked about it by lawmakers ? even after he had been briefed.

"I did not mislead Congress or the American people," Miller said.

The administration is on the defensive for a trio of issues that are threatening to derail the president's second-term agenda. In addition to the IRS case, President Barack Obama and other officials are being pressed about last September's terrorist attack in Benghazi, Libya, that killed the U.S. ambassador and three other Americans, and the government's seizure of Associated Press telephone records as part of a leaks investigation.

"Listening to the nightly news, this appears to be just the latest example of a culture of cover-ups and political intimidation in this administration," said Rep. Dave Camp, R-Mich., chairman of the Ways and Means Committee. "It seems like the truth is hidden from the American people just long enough to make it through an election."

Committee Democrats were also critical of the IRS, but several took offense at Camp's assertion that this matter is part of a wider problem within the administration. They noted that there has been no evidence so far that anyone outside the IRS was involved in targeting conservative groups.

"If this hearing becomes essentially a bootstrap to continue the campaign of 2012 and to prepare for 2014, we will be making a very, very serious mistake," said Rep. Sander Levin of Michigan, the top Democrat on the panel.

Levin said Lois Lerner, who heads the IRS division that makes decisions about tax-exempt groups, "should be relieved of her duties." Lerner is the IRS official who made the scandal public May 10 in what Miller said was a planned event at a legal conference.

Obama forced Miller to resign this week though he will remain on the job a few days until a new acting director takes over. Obama named Daniel Werfel, a top White House budget officer, to replace Miller and met with Werfel on Friday.

Miller is a 25-year IRS employee who was a deputy commissioner when the tea party groups were being targeted. In that job, Miller was over the division that dealt with tax-exempt organizations.

He became acting head of the agency in November, when IRS Commissioner Douglas Shulman's five-year term expired. Shulman had been appointed by President George W. Bush, a fact highlighted by several Democrats at Friday's hearing.

Camp said Miller's departure wouldn't be enough.

"The reality is this is not a personnel problem. This is a problem of the IRS being too large, too powerful, too intrusive and too abusive of honest, hardworking taxpayers," Camp said.

Two other committees have hearings scheduled for next week, and the Justice Department has launched its own criminal investigation. Miller is also scheduled to testify on Tuesday before the Senate Finance Committee. He will be joined by Shulman and George.

Underscoring the seriousness of his testimony Friday, Miller was sworn in as a witness, an unusual step for the Ways and Means panel.

He told committee members that before the episode became public, he had no contact with the Treasury Department, the White House or Obama's re-election campaign about targeting conservative groups.

"Absolutely not," Miller said.

He surprised committee members when he said "it is absolutely not illegal" for IRS agents to single out conservative groups for additional scrutiny.

"Please don't get me wrong," he added. "It should not happen."

George, the inspector general, backed up Miller's assertion when he said the yearlong investigation did not uncover illegal activity.

"It is not illegal, but it was inappropriate," George said of targeting conservative groups.

George's report concluded that an IRS office in Cincinnati, which screened applications for the tax exemptions, improperly singled out tea party and other conservative groups for tougher treatment. The report says the practice began in March 2010 and lasted in various forms until May 2012.

Agents did not flag similar progressive or liberal labels, though some liberal groups did receive additional scrutiny because their applications were singled out for other reasons, the report said.

The IG's report blamed ineffective management in Washington for letting the inappropriate singling out occur for so long.

Miller said he was notified that conservative groups had been singled out for additional scrutiny on May 3, 2012. After he was briefed, members of Congress repeatedly asked the IRS about complaints from tea party groups that said they were being harassed by the IRS.

But Miller was not forthcoming back then about groups being targeted in at least two letters to members of Congress and in testimony before a Ways and Means subcommittee.

"Didn't this committee have the right to know that groups were treated differently?" asked Rep. Dave Reichert R-Wash.

"I answered all the questions I was asked," Miller replied.

"So your answer is a non-answer, once again," Reichert retorted.

As the hearing drew to a close, Camp, the committee chairman, declared, "I promise the American people this investigation has just begun."

Washington state releases draft rules for legal pot

SEATTLE (AP) ? Officials in Washington state took their first stab at setting rules for the state's new marijuana industry Thursday, nearly eight months after voters here legalized pot for adults.

Among the preliminary regulations: They want to track marijuana from "seed to store." They'd put a cap on the number of retail outlets in each county, but not on the number of licensed pot growers or processors.

No sales of what the board described as marijuana extracts, such as hash, would be allowed ? unless the extract is infused into another product ? and all pot-related businesses would have to have security systems, 24-hour video surveillance and insurance.

Any marijuana product sold at state-licensed stores would carry a label noting that it "may be habit forming" and that "this product is unlawful outside of Washington state" ? accompanied by an official pot logo, featuring Washington state with a marijuana-leaf silhouette smack in the middle.

Staff at the state Liquor Control Board spent long hours visiting marijuana grow houses, studying the science of getting high and earning nicknames like "the queen of weed" before issuing the rules.

"They are based upon hundreds of hours of internal research and deliberation, consultation with multiple industry experts and input from the over 3,000 individuals who attended our forums statewide," said Sharon Foster, chairwoman of the state Liquor Control Board.

Foster -- who began a speech at a recent conference by saying, "My friends now call me the queen of weed" ? said the board is trying to create a tightly regulated system that ensures both large and small operations a place in the emerging market.

Last fall voters made Washington and Colorado the first states to legalize the sale of taxed marijuana to adults over 21 at state-licensed stores.

In Colorado, devising rules for the pot industry fell to the Legislature, which has passed a series of bills laying out how marijuana should be grown, packaged and taxed. Gov. John Hickenlooper is expected to sign the bills May 28.

In Washington, people are allowed to have up to an ounce of dried marijuana; 16 ounces of a pot-infused solid, such as brownies; or 72 ounces of a pot-infused liquid, such as tea. The rules issued Thursday are essentially a draft of a draft: After gathering feedback, the Liquor Control Board will issue draft rules next month, then accept more public comment.

Marijuana sales in Washington should begin in early 2014 ? unless the Justice Department has something to say about it. Pot remains illegal federally, and the DOJ could sue to try to block the licensing schemes in Washington and Colorado from taking effect.

Washington Gov. Jay Inslee said Thursday the board "is on the right track."

"I'm impressed with the depth and thoughtfulness of their approach and look forward to moving forward," he said.

When asked if he thought this would satisfy concerns held by U.S. Attorney General Eric Holder, Inslee said "I certainly hope so."

"I don't think you can design a system with much more integrity, as far as tracking the product from the producer to the consumer," he said. "This plan has a robust system of controls and checks in a variety of ways."

Some crucial questions remain ? most notably, how much legal weed will Washington produce? Rand Corp., a subcontractor working for Washington's official pot consultant, is researching pot consumption in the state, and production levels will be based on that data.

Under the 46 pages of rules circulated Thursday, there would be advertising restrictions, including a ban on ads intended to appeal to those under 21.

Washington would use a criminal history point system in determining whether someone is eligible for obtaining a license to grow, sell or process pot. A felony in the past decade or two misdemeanors in the past three years would disqualify an applicant ? but applicants could get a free pass on up to two pot-possession misdemeanors, and any single state or federal conviction for selling, growing or possessing marijuana could be waived on a case-by-case basis.

The board also said it will conduct criminal and financial background checks on "financiers" of pot businesses ? anyone who invests more than $10,000.

The "seed-to-store" system for tracking marijuana, similar to Colorado's system for tracking medical marijuana, is designed to help prevent any pot from being diverted to the black market. It would require growers, processors and retailers to notify the board of any marijuana shipments, and to keep records such as when plants are harvested and destroyed.

Alison Holcomb, the drug policy director at the American Civil Liberties Union of Washington, led the campaign to legalize marijuana under state law. She said she was pleased to see the board balancing public safety and public health with the creation of a workable legal market for marijuana.

But Holcomb also said she was concerned about the board's interpretation of "marijuana-infused product" ? an interpretation that would preclude hash or hash oil ? highly potent forms of pot ? from being sold at stores. The board determined that Washington's voter-approved initiative only allows the sale of marijuana or marijuana-infused products, and that hash is more properly considered an "extract."

If that's true, people in Washington could still be arrested for possessing hash ? which, Holcomb suggested, was not the intent of the measure.

"If you've got hash oil that is 98 percent THC and 2 percent some emulsifying liquid that keeps it in liquid form, I would argue that's marijuana-infused product," Holcomb said.
